• Selain memberikan manfaat bagi kehidupan masyarakat luas, perkembangan teknologi informasi dan komunikasi juga dapat melahirkan berbagai macam kejahatan baru. Sebagai salah satu bentuk dari cybercrime, pencurian uang elektronik melalui phishing mengancam para pengguna online marketplace. Faktor utama dari terjadinya pencurian uang elektronik melalui phishing tersebut adalah kurang adanya kewaspadaan serta kesadaran diri pengguna. Skripsi ini akan membahas mengenai pengaturan dari pencurian uang elektronik pada akun online marketplace melalui phishing serta perlindungan hukum yang diberikan oleh pihak penyelenggara online marketplace terhadap akun online marketplace. Penelitian ini merupakan penelitian hukum (yuridis) normatif, yakni sebuah metode pendekatan dengan menggunakan kaidah-kaidah hukum yang ada sebagai alat untuk menyelesaikan permasalahan yang dihadapi. Penelitian hukum ini dilakukan dengan cara meneliti bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan-peraturan dan literatur-literatur yang berkaitan dengan pencurian uang elektronik pada akun online marketplace melalui phishing. Lalu, spesifikasi penelitian yang digunakan dalam penelitian ini adalah deskriptif analitis, yakni menganalisa objek penelitian dengan memaparkan kasus mengenai pencurian uang elektronik melalui phishing yang terjadi di masyarakat serta melakukan perbandingan pengaturan dengan beberapa negara. Berdasarkan hasil penelitian, perbuatan pencurian uang elektronik pada akun online marketplace melalui phishing tidak diatur secara eksplisit di dalam UU ITE. Namun, pengaturan mengenai pencurian di dalam KUHP serta akses ilegal dengan melewati sistem pengamanan yang mengakibatkan kerugian ekonomis di dalam UU ITE secara tidak langsung mengatur perbuatan tersebut. Selain itu, perlindungan hukum terhadap akun online marketplace oleh pihak penyelenggara dilakukan melalui perlindungan hukum preventif dan perlindungan hukum represif, seperti membuat aturan internal atau menghapus akun milik pelaku. As a form of cybercrime, electronic money theft on online marketplace account by phishing threatens online marketplace users. The main reason of electronic money theft on online marketplace account by phishing is the lack of users’ self-awareness. This research will discuss the regulation of electronic money theft on online marketplace account by phishing and the legal protection provided by the provider for the owner of online market place account from the electronic money theft. This research is a normative legal (juridical) research, which is an approach method that uses existing legal regulations as a tool to solve the problems faced. This legal research is carried out by examining secondary data as basic material to be investigated by tracing the related regulations and literature of electronic money theft on online marketplace account by phishing. Then, the research specification is analytical descriptive, which is analyzing the object of the research by presenting cases of the electronic money theft on online marketplace account by phishing that occur in the community and compare the regulation with several countries. Based on the research, we conclude the regulation of the electronic money theft on online marketplace account by phishing is not explicitly regulated by the EIT Law. However, the regulation regarding theft of Criminal Code and illegal access by passing security systems that inflict economic losses of EIT Law is indirectly regulate these actions. Furthermore, the legal protection for online marketplace account by the organizers is carried out through preventive and repressive legal protection according to the applicable regulations, such as create internal policy or delete the phisher account.
